Cake Order, Collection & Liability Policy
- Final Inspection Upon Collection: Customers (or their designated courier/representative) must thoroughly inspect the cake at the point of collection. Please verify that the design, spelling, colors, size, and overall condition match your order specifications before leaving our premises.
- Customer Sign-off & Confirmation: By taking custody of the cake and leaving our storefront, you formally confirm that the product has been inspected, accepted, and delivered in perfect condition exactly as ordered.
- Strict No Return, No Refund Policy: Because our cakes are custom-made, perishable food items, all sales are final once the cake has been collected. We strictly enforce a no return, no exchange, and no refund policy after the collection has taken place.
- Post-Collection Claims: We do not accept any liability or claims regarding the taste, aesthetic appearance, structure, or design of the cake once it has left our hands.
- Flavor and Texture Subjectivity: Cake flavor and texture are subjective. We do not issue refunds or exchanges if a customer simply dislikes the taste, texture, or flavor profile of a cake, provided the cake was baked fresh and according to the agreed-upon order details.
- Immediate Transfer of Risk: Once the cake is collected, our business is completely released from liability. We are not responsible for any damage, melting, tilting, cracking, or structural collapse that occurs during transit, improper vehicle placement, or handling by third parties.
- Handling & Transport Guidelines: For safety, cakes must be transported on a completely flat, stable surface in an air-conditioned vehicle (the passenger footwell or clean boot is recommended). Do not place the cake on a slanted car seat or a lap.
- Storage & Spoiling: The customer assumes full responsibility for storing the cake according to the instructions provided at collection. We take no responsibility for melting or spoilage caused by leaving the cake in direct sunlight, hot rooms, or un-airconditioned venues.
- Allergen Disclaimer: While we take strict precautions, our kitchen processes nuts, dairy, gluten, eggs, and soy. We cannot guarantee that any product is 100% free from cross-contamination. The customer assumes all responsibility for notifying their guests of potential allergens. We are not liable for any allergic reactions.
- Forfeiture of Uncollected Cakes: Cakes not collected on the scheduled date will be held for a maximum of 2 days. After this timeframe, uncollected items will be discarded for food safety reasons, and the payment will be entirely forfeited with no refunds or store credits issued.
- Intellectual Property & Promotional Rights: The company retains full ownership of all cake designs, concepts, and photographs taken of the product prior to collection. We reserve the right to use any photographs or videos of our products for marketing, promotional, website, or social media purposes.
- Limitation of Liability: In the highly unlikely event of a proven error on our part, our maximum financial liability to the customer is strictly limited to a refund of the amount actually paid for the cake. We are not liable for any indirect, incidental, or consequential damages, including but not limited to emotional distress, venue costs, or event disruption.
